Tenth Circuit Court grants extension in Kitchen v. Herbert

In an order issued today, the Tenth Circuit Court of Appeals has modified their previous timeline and granted the state’s attorneys an extra 7 days to prepare their opening brief.

The order states that “The court will extend the deadline for filing the opening brief by 7 days, and will extend the other dates outlined in our order of December 30, 2013 by a corresponding amount.”

The opening brief is now due on February 3, 2014, with the plaintiffs’ response due by February 25, 2014 and any reply due on or before March 4.
